These Terms and Conditions (hereinafter - "Terms") apply to the online store operating on the website dogful.lv (hereinafter - "Website") and govern all transactions made through this Website.

2. DEFINITIONS

Within these Terms and Conditions:

  • "Buyer" or "Customer" refers to any natural or legal person who purchases products on the Website.
  • "Seller", "We", "Us", or "Our" refers to SIA "Hotdog LV".
  • "Products" refers to all natural dog treats and related pet products offered for sale on the Website.
  • "Website" refers to the online store dogful.lv.
  • "Order" refers to the Customer's request to purchase Products from the Seller.
  • "Contract" refers to the agreement between the Customer and the Seller for the purchase of Products.

3. SCOPE AND APPLICABILITY

3.1. These Terms govern all purchases of natural dog treats and related pet products from the Hotdog LV online store.

3.2. We reserve the right to change these Terms at any time without prior notice. Any changes will take effect immediately upon their publication on the Website. Your continued use of the Website or placement of orders after such changes constitutes your acceptance of the revised Terms.

3.3. The version of the Terms published on the Website at the time of purchase applies to the transaction.

4. ORDERING PROCESS

4.1. Customers can browse our range of Products on the Website, select the desired products, add them to the shopping cart, and proceed to checkout to place an Order.

4.2. During the checkout process, Customers must provide accurate personal information, including:

  • Full name
  • Email address
  • Phone number
  • Delivery address
  • Billing address (if different from the delivery address)

4.3. By submitting an Order, the Customer makes an offer to purchase the selected Products in accordance with these Terms.

4.4. The Contract between the Customer and the Seller is concluded only when the Seller sends an Order confirmation email to the Customer and the payment has been successfully processed.

4.5. The Seller reserves the right to refuse or cancel any Order at its discretion, even after sending an Order confirmation, if:

  • The Products are unavailable or out of stock
  • There is an error in the Product price or description
  • The Order is placed by a Customer who has previously breached these Terms
  • Payment authorization is declined or unsuccessful

4.6. In the event of an Order cancellation, any payment made will be fully refunded.

5. PRICES AND PAYMENT METHODS

5.1. All prices on the Website are indicated in euros (EUR) and include Latvian Value Added Tax (VAT) at the applicable rate.

5.2. The indicated prices do not include delivery costs. Delivery charges will be calculated and added during checkout based on the delivery address and selected delivery method.

5.3. Despite our efforts to ensure price accuracy, errors may occur. If we discover an error in the price of the Products you have ordered, we will inform you as soon as possible and offer you the option to reconfirm the Order at the correct price or cancel it.

5.4. We accept the following payment methods via Revolut payment gateway:

  • Revolut Pay
  • Credit and debit cards: Visa, Mastercard, Maestro

5.5. For bank transfers (if offered), Orders will be processed only after the payment has been received in our account.

5.6. All Orders must be paid in full before they are dispatched.

6. INTERNATIONAL ORDERS AND CUSTOMS

6.1. We ship our Products internationally. However, Customers ordering from countries outside the European Union may be subject to import duties, customs fees, and taxes in their country of residence.

6.2. These additional costs are the Customer's responsibility and are not included in the purchase price or delivery charges.

6.3. SIA "Hotdog LV" is not responsible for any customs delays, additional costs, or any restrictions imposed by customs authorities in the destination country.

6.4. Customers are advised to contact their local customs office for more information on import regulations and potential duties before placing an Order.

7. DELIVERY AND DELIVERY TIMES

7.1. Orders will be processed and prepared for dispatch within 1-2 working days after payment confirmation.

7.2. Estimated delivery times:

  • Latvia: 3-7 working days
  • Other EU countries: 5-14 working days
  • Outside the EU: 10-25 working days
  • Delivery times are estimates and may vary depending on the carrier and destination.

7.3. Delivery times are estimates only and are not guaranteed. Delays may occur due to circumstances beyond our control, including but not limited to:

  • Public holidays
  • Customs inspections for international Orders
  • Issues with local postal or courier services
  • Adverse weather conditions
  • Force majeure events

7.4. We use the following delivery service providers: Omniva, DPD, Latvijas Pasts (Latvian Post).

7.5. A tracking link is provided in your dispatch email.

7.6. If a package is returned to us due to an incorrect address provided by the Customer, the Customer will be responsible for the redelivery costs.

8. RIGHT OF WITHDRAWAL (RETURNS AND REFUNDS)

8.1. In accordance with Latvian and EU consumer rights legislation, Customers have the right to withdraw from the purchase without stating a reason within 14 days from the date on which the Customer or a third party indicated by the Customer (other than the carrier) acquires physical possession of the Products.

8.2. To exercise the right of withdrawal, the Customer must inform us of their decision to withdraw from the Contract by an unequivocal statement (e.g., a letter sent by post or email). The Customer may use the withdrawal form and instructions in our Return & Refund Policy, but it is not obligatory.

8.3. To meet the withdrawal deadline, it is sufficient for the Customer to send their communication concerning their exercise of the right of withdrawal before the 14-day withdrawal period has expired.

8.4. Conditions for return:

  • Products must be unused, undamaged, and in their original packaging.
  • The Customer must include proof of purchase (order number or receipt).
  • The Customer is responsible for covering the cost of returning the Products, except in cases where the Products are defective, damaged, or incorrectly delivered.

8.5. Exceptions to the right of withdrawal:

  • Perishable goods with a short expiry date.
  • Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
  • Custom-made or personalized goods.

8.6. If the Customer withdraws from the Contract, we will reimburse all payments received from the Customer, including delivery costs (except for supplementary costs arising if the Customer chose a type of delivery other than the least expensive type of standard delivery offered by us).

8.7. We may withhold reimbursement until we have received the returned Products back or until the Customer has supplied evidence of having sent back the Products, whichever is the earliest.

8.8. The reimbursement will be made using the same means of payment as the Customer used for the initial transaction unless the Customer has expressly agreed otherwise.

9. PRODUCT INFORMATION, QUALITY, AND USE

9.1. SIA "Hotdog LV" sells 100% natural dog treats and related pet products. We strive to provide accurate Product descriptions and images on our Website.

9.2. Product photos are illustrative and may not exactly match the delivered product. Natural variations in color, texture, and shape are normal and do not constitute a defect.

9.3. The Customer is responsible for checking for any potential allergies or dietary restrictions their dog may have before purchasing our Products.

9.4. Usage guidelines:

  • Always supervise your pet while it enjoys treats.
  • Store Products in a cool, dry place unless otherwise indicated.
  • Follow the recommended daily portion based on your dog's size and weight.
  • Treats should not constitute more than 10% of your dog's daily caloric intake.

9.5. Product expiry dates are indicated on the packaging. We do not dispatch Products that are nearing their expiry date.

10. DAMAGED OR DEFECTIVE GOODS

10.1. All Products sold by SIA "Hotdog LV" are covered by a legal guarantee of conformity in accordance with Latvian and EU consumer protection laws.

10.2. If the delivered Products are damaged, defective, or do not conform to the description on the Website, the Customer should notify us within a reasonable time (ideally within 7 days from discovering the defect) by sending an email with photographic evidence of the issue.

10.3. In the case of a justified claim, the Customer is entitled to:

  • Replacement of the defective Products.
  • Repair of the defective Products (if applicable).
  • A full or partial refund.

10.4. These Terms do not affect the Customer's statutory rights.

11. LIMITATION OF LIABILITY

11.1. SIA "Hotdog LV" will not be liable for:

  • Any delays or failure to perform our obligations due to circumstances beyond our reasonable control (force majeure).
  • Any adverse reactions or health problems resulting from the consumption of our Products if proper storage and usage guidelines are not followed.
  • Indirect or consequential losses arising from or in connection with the use of our Products.

11.2. While we strive to ensure accurate Product descriptions and information on the Website, we reserve the right to correct errors, inaccuracies, or omissions, and to change or update information at any time without prior notice.

11.3. Our total liability to the Customer in respect of all losses arising under or in connection with the Contract shall not exceed the total price of the relevant Products.

11.4. Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any matter for which it would be illegal for us to exclude or limit our liability.

12. DATA PROTECTION AND PRIVACY

12.1. SIA "Hotdog LV" processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and Latvian data protection laws.

12.2. By placing an Order, the Customer consents to the collection and processing of their personal data for the following purposes:

  • Order fulfillment and processing
  • Communication with the Customer
  • Arranging delivery
  • Payment processing
  • Direct marketing activities (only if the Customer has expressly consented).

12.3. We will not disclose the Customer's personal data to third parties, except where necessary for Order fulfillment (e.g., providing delivery address data to delivery service providers) or if required by law.

12.4. Customers have the right to:

  • Access their personal data held by us
  • Request correction of inaccurate data
  • Request deletion of their data
  • Object to data processing
  • Data portability

13. MARKETING AND COMMUNICATION

13.1. Customers can opt-in to receive our newsletter and promotional materials during the registration process or at checkout.

13.2. Customers can unsubscribe from marketing communications at any time by:

  • Clicking the "unsubscribe" link in any email.
  • Contacting us directly at info@dogful.lv.
  • Updating their preferences in their account settings.

13.3. We may continue to send non-marketing communications (e.g., Order confirmations and updates) regardless of marketing preferences.

14. INTELLECTUAL PROPERTY AND COPYRIGHT

14.1. All content on the Website, including but not limited to text, graphics, logos, images, product descriptions, page layout, and design, is the property of SIA "Hotdog LV" or its content suppliers and is protected by Latvian and international copyright and intellectual property laws.

14.2. Customers may not copy, reproduce, distribute, publish, display, modify, create derivative works from, transmit, or in any way exploit any part of the Website without our express written permission.

14.3. Trademarks, service marks, and logos found on the Website are registered and unregistered trademarks of SIA "Hotdog LV" or third parties. Nothing on the Website should be construed as granting any license or right to use any trademark without the prior written permission of the trademark owner.

15. GOVERNING LAW AND DISPUTE RESOLUTION

15.1. These Terms are governed by and construed in accordance with the laws of Latvia.

15.2. In the event of a dispute, the parties will attempt to resolve the matter amicably through direct negotiations.

15.3. If a solution is not reached within 30 days from the start of negotiations, either party may submit the dispute to the courts of Latvia, which shall have exclusive jurisdiction.

Note: The EU Online Dispute Resolution (ODR) platform has been discontinued; use the European Commission’s Consumer Redress resources instead.

15.5. These Terms do not affect the Customer's statutory rights under applicable consumer protection laws.

15.6. In the event of any discrepancies or conflicts between translations of these Terms, the version governed by Latvian law shall prevail.

16. AMENDMENTS TO THE TERMS

16.1. SIA "Hotdog LV" reserves the right to change these Terms and Conditions at any time by posting updates on the Website.

16.2. The new provisions shall take effect upon their publication on the Website.

16.3. Customers are advised to regularly check these Terms for any changes.

16.4. Continued use of the Website or placement of Orders after changes constitutes acceptance of the revised Terms.

18.3. By confirming a purchase on our Website, the Customer fully agrees to these Terms and Conditions.

18.4. These Terms constitute the entire agreement between the Customer and SIA "Hotdog LV" regarding the use of the Website and the purchase of Products. Any prior agreements, whether written or oral, are superseded by these Terms.
